Gentlemen of the jury, I entreat you in Heavens name not to permit him, after voluntarily reinstating me, reversing the previous decision, and renouncing his anger, to revive the old sentence and have recourse to the same paternal rights; the period of their validity is past and gone; his own act suffices to annul and exhaust their power. You know the general rule of the courts, that a party dissatisfied with the verdict of a ballotprovided jury is allowed an appeal to another court; but that is not so when the parties have agreed upon arbitrators, and, after such selection, put the matter in their hands. They had the choice, there, of not recognizing the court ab initio; if they nevertheless did so, they may fairly be expected to abide by its award, Similarly you, sir, had the choice of never taking back your son, if you thought him unworthy; having decided that he was worthy, and taken him back, you cannot be permitted to disinherit him anew; the evidence of his not deserving it is your own admission of his worth, It is only right that the reinstatement and reconciliation should be definitive, after such abundant investigation; there have been two trials, observe: the first, that in which you rejected me; the second, that in your own conscience, which reversed the decision of the other; the fact of reversal only adds force to

v.2.p.190
tthe later result. Abide, then, by your second thouglits, and uphold your own verdict. You are to be my father; such was your determination, approved and ratified.

Suppose I were not your begotten, but only your adopted son, I hold that you could not then have disinherited me; for what it is originally open to us not to do, we have no right, having done, to undo, But where there is both the natural tie, and that of deliberate choice, how can a second rejection, a repeated deprivation of the one relationship, be justified? Or again, suppose I had been a slave, and you had seen reason to put me in irons, and afterwards, convinced of my innocence, made me a free man; could you, upon an angry impulse, have enslaved me again? Assuredly not; the law makes these acts binding and irrevocable. Upon this contention, that the voluntary annulment of a disinheritance precludes a repetition of the act, I could enlarge further, but will not labour the point.

You have next to consider the character of the man now to be disinherited. I lay no stress upon the fact that I was then nothing, and am now a physician; my art will not help me here. As little do I insist that I was then young, and am now middle-aged, with my years as a guarantee against misconduct; perhaps there is not much in that either. But, gentlemen, at the time of my previous expulsion, if I had never done my father any harm (as I should maintain), neither had I done him any good; whereas now I have recently been his preserver and benefactor; could there be worse ingratitude than so, and so soon, to requite me for saving him from that terrible fate? My care of him goes for nothing; it is lightly forgotten, and I am driven forth desolateI, whose wrongs might have excused my rejoicing at his troubles, but who, so far from bearing malice, saved him and restored him to his senses.

For, gentlemen, it is no ordinary slight kindness that he is choosing this way of repaying. You all know (though he may

v.2.p.191
not realize) what he was capable of doing, what he had to endure, what his state was, in fact, during those bad days. The doctors had given him up, his relations had cleared away and dared not come near him; but I undertook his case and restored him to the power ofaccusing me and going to law. Let me help your imagination, sir. You were very nearly in the state in which your wife now is, when I gave you back your understanding. It is surely not right that my reward for that should be thisthat your understanding should be used against me alone. That it is no trifling kindness I have done you is apparent from the very nature of your accusation. The ground of your hatred is that she whom I do not cure is in extremities, is terribly afflicted; then, seeing that I relieved you of just such an affliction, there is surely better reason for you to love and be grateful to me for your own release from such horrors. But you are unconscionable enough to make the first employment of your restored faculties an indictment of me; you smite your healer, the ancient hate revives, and we have you reciting the same old law again. My arts handsome fee, the worthy payment for my drugs, isyour present manifestation of vigour!

But you, gentlemen of the jury, will you allow him to punish his benefactor, drive away his preserver, pay for his wits with hatred, and for his recovery with chastisement? I hope better things of your justice. However flagrantly I had now been misconducting myself, I had a large balance of gratitude to draw upon. With that consideration in his memory, he need not have been extreme to mark what is now done amiss; it might have inspired him with ready indulgence, the more if the antecedent service was great enough to throw anything that might follow into the shade. That fairly states my relation to him; I preserved him; he owes his life absolutely to me; his existence, his sanity, his understanding, are my gifts, given,

cleared 1 w 2876
away 1 w 2880
and 21 w 2883
dared 1 w 2888
not 17 w 2891
come 1 w 2895
near 1 w 2899
him 11 w 2902
but 5 w 2906
I 17 w 2907
undertook 1 w 2916
his 12 w 2919
case 1 w 2923
and 22 w 2926
restored 2 w 2934
him 12 w 2937
to 25 w 2939
the 55 w 2942
power 2 w 2947
of 21 w 2949
accusing 1 w 2958
me 18 w 2960
and 23 w 2963
going 1 w 2968
to 26 w 2970
law 2 w 2973
Let 1 w 2977
me 19 w 2979
help 2 w 2983
your 9 w 2987
imagination 1 w 2998
sir 2 w 3002
You 5 w 3006
were 2 w 3010
very 1 w 3014
nearly 1 w 3020
in 53 w 3022
the 56 w 3025
state 3 w 3030
in 54 w 3032
which 3 w 3037
your 10 w 3041
wife 1 w 3045
now 7 w 3048
is 35 w 3050
when 2 w 3055
I 18 w 3056
gave 1 w 3060
you 20 w 3063
back 3 w 3067
your 11 w 3071
understanding 1 w 3084
It 2 w 3087
is 36 w 3089
surely 1 w 3095
not 18 w 3098
right 4 w 3103
that 15 w 3107
my 8 w 3109
reward 1 w 3115
for 7 w 3118
that 16 w 3122
should 3 w 3128
be 15 w 3130
this 3 w 3134
that 17 w 3139
your 12 w 3143
understanding 2 w 3156
should 4 w 3162
be 16 w 3164
used 2 w 3168
against 2 w 3175
me 20 w 3177
alone 1 w 3182
That 1 w 3187
it 25 w 3189
is 38 w 3191
no 31 w 3193
trifling 1 w 3201

very 2 w 3242
nature 1 w 3248
of 22 w 3250
your 13 w 3254
accusation 1 w 3264
The 3 w 3268
ground 1 w 3274
of 23 w 3276
your 14 w 3280
hatred 1 w 3286
is 40 w 3288
that 18 w 3292
she 1 w 3295
whom 1 w 3299
I 21 w 3300
do 11 w 3302
not 19 w 3305

that 19 w 3360
I 22 w 3361
relieved 1 w 3369
you 26 w 3372
of 24 w 3374
just 2 w 3378
such 4 w 3382
an 45 w 3384
affliction 1 w 3394
there 6 w 3400
is 43 w 3402
surely 2 w 3408
better 1 w 3414
reason 2 w 3420
for 8 w 3423
you 27 w 3426
to 27 w 3428
love 1 w 3432
and 26 w 3435
be 18 w 3437
grateful 1 w 3445
to 28 w 3447
me 21 w 3449
for 9 w 3452
your 15 w 3456
own 5 w 3459
release 1 w 3466
from 4 w 3470
such 5 w 3474
horrors 1 w 3481
But 3 w 3485
you 29 w 3488
are 6 w 3491
unconscionable 1 w 3505
enough 1 w 3511
to 29 w 3513
make 2 w 3517
the 60 w 3520
first 2 w 3525
employment 1 w 3535
of 25 w 3537
your 16 w 3541
restored 3 w 3549

the 61 w 3597
ancient 1 w 3604
hate 1 w 3608
revives 1 w 3615
and 27 w 3619
we 7 w 3621
have 11 w 3625
you 33 w 3628
reciting 1 w 3636
the 62 w 3639
same 2 w 3643
old 4 w 3646
law 3 w 3649
again 5 w 3654
My 2 w 3657

But 4 w 3740

his 15 w 3812
preserver 2 w 3821
pay 3 w 3825
for 11 w 3828
his 16 w 3831
wits 1 w 3835
with 3 w 3839
hatred 2 w 3845
and 29 w 3849
for 12 w 3852
his 17 w 3855
recovery 1 w 3863
with 4 w 3867
chastisement 1 w 3879
I 23 w 3881

However 1 w 3918

now 8 w 3935
been 4 w 3939

myself 1 w 3958
I 25 w 3960
had 11 w 3963
a 293 w 3964
large 2 w 3969
balance 1 w 3976
of 30 w 3978
gratitude 2 w 3987
to 33 w 3989
draw 1 w 3993
upon 4 w 3997
With 1 w 4002
that 20 w 4006

That 2 w 4212
